In 1995, Governor Pataki signed legislation that created the Sex Offender Registry. The Sex Offender Registry requires, among other things, that those individuals convicted of certain designated sex offenses register with the Division of Criminal Justice Services (DCJS) and notify DCJS of their current address and when they move.
A federal court case was brought against the State challenging the new law. The U.S. Federal District Court for the Southern District of New York issued an injunction preventing DCJS and local police agencies from providing community notification, except through the toll free DCJS 800 Number (1-800-262-3257), for certain offenders, until a due process hearing could be conducted to determine the convicted sex offender's risk level.
After several years of litigation, a settlement has been reached which will now allow these convicted sex offenders an opportunity for notice and a hearing to determine an appropriate risk level. Working with the Office of Court Administration, DCJS is monitoring the scheduling of these hearings. As these hearings are conducted for each individual sex offender, local law enforcement will be authorized to provide community notification for Level 2 and Level 3 sex offenders and DCJS will post information about each Level 3 sex offender on the DCJS web page at www.criminaljustice.ny.gov.
