The Montgomery County Probation Department oversees the Pretrial Services program.  While part of the goal of our pretrial program is jail population management, the other part is to provide a greater function of assisting the courts in determining which defendants are eligible for program participation and who may be unable to make bail or post a bond.  Our program is structured to assist the county-wide justice system to maintain effective, efficient, realistic court control of participants placed in our program by the courts' decisions, as agreed upon by the defendant.  Program participation is a privilege granted by the judge during the pre-dispositional status of the matter before the court, releasing a defendant from incarceration or in-lieu-of an incarcerated setting, allowing the defendant our program services.  Our program is charged with two primary objectives: 1) Provide the courts with verified universal screening/intake information for defendants who may be considered for possible program participation.  2)  Monitor each person released to program supervision.  The population served by our program includes all persons initially unable to post bail or not released on his/her own recognizance.  All defendants that are deemed eligible, upon completion of the review and screening process, will be granted an interview.  Upon interviewing these defendants, utilizing the objective interview format with the point scale that reveals information concerning a defendant's ties to the community, including present and past residences, family ties and other social contacts; employment and present financial resources; prior record; a defendant's individual ties to the community (such as school, training, public assistance, welfare, etc.) and the names and telephone numbers of persons who can assist with information verification, when available.  By utilizing this process, all defendants that should be excluded, are, and the remainder are effectively provided with our program's services.  In addition, our program utilizes treatment agencies and service providers to complete needed assessments and appropriate treatment programs prior to the release of any defendants.

This program began operation in 1985. This project provides the criminal courts with a sentencing alternative through the use of community service for offenders with sentences of adjournment in contemplation of dismissal, conditional discharge or probation. Offenders will be required to make reparation for their crimes through performance of community service. The project will monitor compliance with release conditions. Project operations also include offender selection, worksite selection and oversight, court/probation notification activities, referrals to human services and management of accident/liability reports.
