DNA REFORM: S.5894.  Amends the Criminal Procedure Law, Executive Law, Penal Law, and Court of Claims Act to require collection of DNA samples from everyone convicted of a crime, adjudicated a youthful offender, or required to register as a sex offender, and to ensure proper collection of such samples; to establish guidelines to promote reliability of identification procedures; to preclude the Division of Criminal Justice Services from including undisposed case information on criminal history records, except those released to qualified agencies; to expand the access of defendants to potentially exculpatory DNA evidence; to require prosecutors to alert courts to exculpatory evidence and authorizes prosecutors to move for convictions to be vacated; to eliminate overly restrictive limits on compensation for wrongful convictions; and to expand the jurisdiction of the Forensic Science Commission to include non-binding standards for use of forensic evidence.
