Comments: As the result of a discharge to the office of Mental Health, the inmate may or may noy be returned to DOCS custody to serve the balance of the term, as the OMH commitment supersedes the legal commitment.

A court ordered discharge legally terminates sentence prior to expiration, but can be effectively voided by resentencing under the original Indictment/Superior Court Information (SCI).
