Coded Law File
Law File Changes - September 7, 2007
Note: Laws added to the file since the last posting on April 16, 2007 begin with relative address/law ordinal 7610. Be aware, however, that changes/corrections have been made to existing laws. A summary is shown below, but may not be complete. We recommend that you overwrite the existing law file with the new one.
Chapter 7 (bill S3318) enacted the Sex Offender Management and Treatment Act. This extensive legislation encompassed many law changes, including the creation of a new class of offense, “Sexually Motivated Felony,” under PL 130.91. These have been updated to the coded law file in a similar manner as Hate Crimes: a new law for each of the specified offenses has been updated with a new law ordinal and a subsection which ends in “X,” to denote the “sexually motivated” version. These offenses have the same class and category as the underlying offenses, but are subject to sentence enhancement.
Chapter 8 amended the offense of Disseminating Indecent Material to Minors, ensuring that graphic written text transmitted to a minor via computer falls within the purview of the statute. The change took effect on 3/19/2007.
Chapter 373 (bill S6277) amended the Correction Law, in relation to the failure to register or verify under the Sex Offender Registration Act. A first offense was increased in severity from a class A Misdemeanor to a class E Felony. (Note: Violations of 168-v were not changed.)
